McKinney & Mill Wildfire Litigation

The McKinney Fire, which has so far consumed nearly 60,000 acres began on July 29th in the Klamath National Forest near the Oregon state border and has become California’s largest blaze this year.

Governor Gavin Newsom of California declared a state of emergency for Siskiyou County where nearly 3,000 people have been ordered to evacuate. CAUSE OF THE MCKINNEY FIRE

The cause of the wildfire is still under investigation, but NBC news reports the McKinney fire “began underneath a power line circuit that had trouble just hours earlier.”

THE MILL FIRE

Started on Friday, 9/2 near the Roseburg Forest Products property. It was first reported as a structure fire at RFP timber mill. Rebecca Taylor, spokesperson for RFP, “We don’t know how or where the fire started. Whether it started right on the edge of the property or on the property.” So far 118 structures have been destroyed, hundreds more threatened and 26 structures damaged. Including 2 civilian fatalities, 3 civilian injuries, over 3900 acres have burned with containment at 75%.

CAUSE OF THE MILL FIRE

Allegedly caused by a negligent operations procedure or third-party equipment.

If that allegation is correct, there may be an issue of exemplary or punitive damages if the wrongdoer knew of the dangerous condition or procedure and continued to implement that after being cited.

So far, no evidence of Pacific Power involvement and the cause. The only allegedly negligent party now is the Roseburg Forest Products company and or principals.

This is only an allegation at this point based on purportedly reliable evidence.
