Some of the most common accidents involving recreational boats include:

  • Collisions with another vessel or structure
  • Capsizing
  • Falling overboard
  • Fire
  • Explosions
  • Sinking or flooding

A significant percentage of recreational boat accidents involve the use of alcohol. LONGSHORE & HARBOR WORKERS’ COMPENSATION ACT

Frantz Law Group, represents maritime workers in accident cases filed under the Jones Act, Longshore and Harbor Workers’ Compensation Act and other federal statutes. Our law firm will provide vigorous, results-oriented representation designed to obtain the best possible settlement or jury award for you. Are you a construction worker who was injured while working on a bridge, dock, jetty or another maritime structure? You may be able to file a claim under the Longshore and Harbor Workers’ Compensation Act. This could enable you to obtain significantly more compensation than you would receive from a regular workers’ compensation claim.

The benefits of the Longshore Act includes all medical expenses, rehabilitation as well as your cost of travel to receive the treatment. It also provides compensation for all types of disabilities. If death has resulted while on-the-job, the widow/widower or other eligible survivors are entitled to reasonable funeral expenses up to a maximum of $3000.

Who are covered by the Longshore Act?

  • Longshoremen
  • Harbor workers
  • Ship repairmen
  • Ship-breakers

JONES ACT BENEFITS

In addition to the Longshore and Harbor Workers’ Compensation Act, you may also file for the Jones Act or Merchant Marine Act of 1920. This statute protects seamen who are injured or killed while working on a vessel in navigable waters. The Jones Act is a fault-based system, which means that proving negligence is of utmost importance to receive compensation.

How to qualify for benefits?

  • You must have spent at least 30 percent of your time on a vessel at the time the injury occurred.
  • You must have been assigned to a vessel or fleet of vessels such as cargo boats, drilling ships, transportation vessels, and supply boats.
  • You must have been working on a vessel in navigation, meaning that the vessel is still capable of moving about with a few modifications.

Financial benefits covered by the Jones Act includes:

  • Living expenses while off work as a result of your injuries
  • Medical bills including medications and rehabilitation
  • Vocational training for a new job if your injury has prevented you from coming back to your previous job

At Frantz Law Group, our personal injury attorneys in California can assist you in filing for your claim and represent you in court. We are knowledgeable on what the judge will look for and can help you avoid any pitfalls that may prevent you from getting the compensation you deserve.

WRONGFUL DEATH CLAIMS IN BOATING ACCIDENTS

When the negligent act of another causes a boating accident that subsequently led to a wrongful death, the victim’s surviving families may be eligible to file a claim. At Frantz Law Group, we understand that pursuing legal action or compensation can never bring back the loss of a loved one. However, this may be the only way to obtain the justice that your deceased loved one and your family deserve.

We are determined to recover the maximum amount of damages for the following:

  • Medical bills incurred before death
  • Funeral costs
  • Loss of future income
  • Loss of companionship
  • Other losses

Our California personal injury attorneys can provide a thorough investigation to ensure that the liable parties are held accountable for your loved one’s passing. We also have a network of accident recreation experts and specialists that can help us validate your claim.
