On Sunday, October 1, 2017, the nation was rocked by the report that a man had fired hundreds of times into a country music festival, killing at least 58 people and injuring more than 500 in one of the largest mass shootings in recent history. The crowd at the Route 91 Harvest Festival had more than 22,000 people in attendance, and the suspect shot with automatic weapons into the crowd from the 32nd floor of the Mandalay Bay Hotel.

The suspect, Stephen Paddock, used an arsenal of weapons in his hotel room at Mandalay Bay Hotel to shoot 400 yards away at the concert site. The Las Vegas Metro Police Department (LVMPD) found 23 guns, thousands of rounds of ammunition in the hotel room, and more than 10 suitcases in the room. However, it’s still unclear how the shooter managed to get such a cache of deadly weapons past hotel security.

During our investigation, we have already found that over one year ago, Steve Wynn of the Wynn Las Vegas Resort & Casino, allegedly warned fellow casino owners that Las Vegas was a “target city” and that greater security measures were necessary to prevent a large scale attack. After this warning, the Wynn instituted new security measures, including invisible metal detectors and specially trained and armed counterterrorism officers due to significant safety concerns at or near Las Vegas resorts and casinos.
Around the world, luxury properties have implemented heightened security procedures to prevent the foreseeable possibility of a mass casualty shooting. It appears that Mandalay Bay Resort & Casino had instituted security procedures which failed to detect the gunman’s 23 firearms including military-style assault weapons and thousands of rounds of ammunition which were brought onto their property and were used to kill and injure more than 500 innocent victims. Moreover, the gunman remained on the property for more than 3 days with his weapons and ammunition in the hotel room. Had Mandalay Bay heeded the security warning one year earlier and installed a metal detection system, they may well have detected the weapons and ammunition that the shooter brought into the hotel before any violence could occur.
Under general principles of premises liability law, all Las Vegas hotels and casinos are obligated to provide reasonably safe and secure conditions on their properties. However, there are questions about whether Mandalay Bay provided the best available security measures.
