- Municipal, county and state traffic laws
- Federal trucking regulations
Determining who was at fault in an accident involving a commercial truck is not as straightforward as after a similar accident involving only private cars. In the case of semi truck accidents, violations of federal trucking regulations can provide evidence that a truck driver or a commercial motor carrier in charge of the truck driver was at fault — and liable to compensate the injured.
AN INVESTIGATION WILL INCLUDE CONSIDERATION OF STANDARD TRUCKING RULES OF THE ROAD
State traffic laws specific to trucks also apply. Any driver in California, for example, is expected to follow the rules of the road that are found in Division 10 of the California vehicle code. Some rules apply specifically to trucks, such as imitations in terms of driving hours: “A motor carrier shall not permit or require a driver to drive, nor shall any driver drive, for any period after having been on duty for 80 hours in any consecutive eight days.”
